(“Yourgi”, “we”, “us” or “our”) cares about your privacy and has developed this Privacy Policy (this “Policy”) to describe the information we collect, how that information may be used, with whom it may be shared, and your choices, in connection with your use of our website located at YourgiPet.com, any related subdomains, and any other websites that we link to this Policy (collectively, the “Website”), and our mobile application (the “App”). The App and the Website, and all related services, content and other resources available on or enabled via the App and the Website shall be considered the “Services.”
This Policy is incorporated into, and is part of, our Terms of Service available at yourgipet.com/terms-of-service, which governs your access to and your use of our Services. By accessing the Services, you agree to be bound by this Policy. If you do not agree to the terms of this Policy, please do not use the Services. Each time you use the Services, the current version of this Policy will apply. Accordingly, when you use the Services, you should check the date of this Policy (which appears at the top) and review any changes since you last reviewed the Policy.
INFORMATION WE COLLECT
We collect two types of information from users of our Services: “personal information,” which is information that can be used to identify you (such as your name or phone number), and “aggregate information,” which is information that cannot be used to identify you (such as frequency of visits to our Website and your browser type). We collect personal information and aggregate information in the contexts described below. If you choose to share information publicly or with third-parties through our Services, please understand that we cannot control the actions of other users and third-parties who could access and collect this information.
In general, we collect information from you so that we can provide our Services, operate our business, and provide information that you request from us.
Information You Provide to Us
- Yourgi Account Information
When you register for a Yourgi account, we collect contact information such as your name, phone number, email address, and postal address.
- Use of the Services
In the normal course of using the Services, you may also provide us with additional information about yourself, your pet, and your pet’s health and care information. The information you provide will depend on which features of the Services you use.
- Your Communication with Us
We collect information when you communicate with us. The specific types of information we collect will depend on the forum in which you communicate with us. For example, if you send us an email, we will collect your email address and the content of your email. You may also participate in surveys and questionnaires, in which case, we collect the any information that you provide to us in response.
- Location Information
With your permission, or if your device’s location settings are enabled to allow our app to collection this data, the Services may collect your geolocation data.
- Rewards Program
If you are part of our rewards program, we may collect your contact information such as your name, email address, physical address, and phone number, and collect information through your use of the program. For example, if you purchase products or services from third-parties affiliated with the rewards program, we may receive information about your transaction.
- Payments
If you submit payments through the Services, including for purchases from third-party products and services made available via the Services, your payment information is processed by our third-party payment processor. We never have access to your full payment card details, however, we may receive information about your transaction.
- Referrals
If you refer a friend to us, you may provide contact information of your friend. Please do not share any information with us that you do not have permission to share. If you were referred to us by a friend, we may alert your friend that you have created a Yourgi account or used our Services.
- Feedback and Research
You may provide us feedback and user research responses in connection with your use of the Services. Please note that this information may be collected and analyzed by third-parties on our behalf.
Information We Automatically Collect
As with most apps and websites, when you use our Services we automatically receive and collect information from your device. This information includes the following:
- Information about your device, such as the operating system, hardware, system version, the Internet Protocol (IP) address, device ID, and device language.
- The specific actions that you take when you use our Services, including but not limited to the pages and screens that you view or visit, search terms that you enter, how you interact with our Services, and information about your interactions with other users.
- The time, frequency, connection type, and duration of your use of our Services.
- Information about your wireless and mobile network connections, such as mobile phone number, service provider, and signal strength.
- Information regarding your interaction with email messages, for example, whether you opened, clicked on, or forwarded the email message.
- Identifiers associated with cookies or other technologies that may uniquely identify your device or browser (as further described below); and
- Pages you visited before or after navigating to our Website.
Cookies and Analytics
Cookies are alphanumeric identifiers that we transfer to your device’s hard drive through your web browser to help us identify you when you come to our Website. You have choices with respect to cookies. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies you may be unable to use those aspects of our Website that requires registration in order to participate. Doing so, however, may disable certain features on our Website. You can opt-out from third party cookies that are used for advertising purposes on the NAI website at http://www.networkadvertising.
We may use third parties, such as Google Analytics or other analytics providers, to analyze traffic to our Website. Google Analytics does not create individual profiles for visitors and only collects aggregate data. To disable Google Analytics, please download the browser add-on for the deactivation of Google Analytics provided by Google at http://tools.google.com/dlpage/gaoptout?hl=en. You have the option to opt out of Google’s use of cookies by changing your settings through Google Ad Settings via the Google advertising opt-out page.
We may also use cookies, pixels, beacons, or other web tracking technologies to track the amount of time spent on our Website or social media and whether or not certain content, such as a video was viewed. We may work with a third party to collect and process this information for us, based on our instructions and in compliance with this Policy.
At the present time our Website does not respond to “Do Not Track” signals or similar mechanisms.
Interest-Based Advertising and Meta Pixel
We may also participate in interest-based advertising. This means that you may see advertising on our Website tailored to how you browse, or you may see advertising for Yourgi on other websites based on your browsing behavior across websites. Some websites where we may advertise belong to ad networks that use your web browsing history to choose which ads to display on their network websites; these ads include advertising for Yourgi and its Services. Other websites where you see our ads, such as Facebook, may use interest preferences that you have chosen on those sites, as well as registration and other information about you, to choose which ads to display to you. Some internet browsers, websites such as Facebook and mobile devices offer opt-outs for interest-based advertising. Please refer to the website that you are visiting, your browser and/or your device settings for additional information.
You can opt-out of receiving interest-based ads from third parties who are members of the Network Advertising Initiative (NAI) or who follow the Digital Advertising Alliance’s Self-Regulatory Principles for Online Behavioral Advertising by visiting the opt-out pages on the NAI website (http://www.networkadvertising.org/choices/) and DAA website (http://www.aboutads.info/choices/).
We use Meta Pixel to customize our advertising and to serve you ads on your social media based on your browsing behavior. This allows your behavior to be tracked after you have been redirected to our Website by clicking on the Facebook ad. The Meta Pixel stores a cookie on your device to enable us to measure the effectiveness of Facebook ads for statistical and market research purposes. We do not have access to the information collected through the Meta Pixel. However, the information collected via the Meta Pixel is also stored and processed by Facebook. Facebook may link this information to your Facebook account and also use it for its own promotional purposes in accordance with Facebook’s Data Usage Policy. The Meta Pixel also allows Facebook and its partners to show you advertisements on and outside of Facebook. You can opt-out of displaying Facebook ads by visiting your Facebook Ad Settings, and you can clear and control the information third parties share with Facebook in your Off-Facebook Activity page. If you do not have a Facebook account, you can opt-out of Facebook ads through the Digital Advertising Alliance as describe above.
Third-party Automated Collection
We and our service providers use anonymous identifiers such as cookies and other technologies to collect and store certain types of information (such as click stream information, browser type, time and date, subject of advertisements clicked or scrolled over, hardware/software information, cookie and session ID) whenever you interact with us or third-parties that use our Services.
We also allow third-party companies (such as Google) to place tags on our digital properties once approved through our tagging process. The tags may collect information from your interactions on our Website. Our Policy does not cover these third-party companies. Please contact these third-party companies for more information about their privacy practices and your choices regarding the tags and the information collected by the tags.
Session Replay
We may use session replay technologies on our Website or other digital properties. Session replay is the reproduction of a user’s interactions on a website or web application exactly or as close as possible to how the user actually experienced it. These technologies store users’ digital interactions on websites and apps down to the individual clicks, taps, scrolls, mouse movements, etc. to create a DVR-like reproduction of those experiences. We use these technologies for a variety of purposes, including but not limited to, user support, debugging errors, optimization, and analysis.
Employment
If we have collected your information through our “Careers” page in response to a job opening, you are giving us permission to use and retain your information for the purpose of evaluating your application for employment consideration for the specific position that you applied to, as well as other roles at Yourgi. This information may be processed and stored by a third-party talent tracking solution provider as well as with vendors, consultants, and other service providers who need access to such information to carry out work relating to the recruitment process on our behalf.
HOW WE USE YOUR INFORMATION
In general, we use personal information that we collect from you to provide our Services, operate our business, and provide information that you request from us. This includes the following uses and purposes:
- Create and administer your Yourgi account.
- Facilitate appoint requests and bookings related to pet services and care.
- Provide, operate, improve, maintain, and protect our Services.
- Provide you with technical and other support.
- Facilitate actions that you take in the Services.
- Send you Services and company updates, marketing communication, and other information about Yourgi and our Services, and products and services of third parties, that we think you may be interested in.
- Conduct research and analysis, and monitor and analyze trends and usage.
- Enhance or improve user experience, our business, and our Services, including the safety and security thereof.
- Send you push notifications through the App.
- Personalize our Services to you by, for example, customizing the content that you see.
- Communicate with you and respond to inquiries.
- Operate our business and perform any other function that we believe is necessary to protect the security or proper functioning of our Services.
- As necessary to comply with any applicable law, regulation, subpoena, legal process, or governmental request.
- Enforce contracts and applicable Terms of Service, including investigation of potential violations thereof.
- Detect, prevent, or otherwise address fraud, security or technical issues.
- Protect against harm to the rights, property or safety of Yourgi, our Services, our users, customers, or the public as required or permitted by law.
HOW WE SHARE YOUR INFORMATION
Like most companies, we share information in certain circumstances with third parties through operation of our Services and our business. Below we explain when that happens.
Pet Care Providers
If you use our Services to request or pet-related care or services, such as pet grooming, boarding, or other pet care, you are giving us consent to share your contact information, your profile information, and information about your pet with pet-related care and services providers.
Please note that this Policy does not apply to, and Yourgi is not responsible in any way for, the privacy or security practices of pet care providers, which may differ from those set forth in this Policy. Please see the privacy policy and privacy notices of the applicable pet care provider to learn more about how the pet care provider handles your information.
If you have any questions or would like to exercise your legal rights regarding any information handled by a pet care provider, please contact the applicable pet care provider.
Services Providers
We use third parties to assist us with operating our business and providing our Services, such as our technology vendors that help us maintain our Services, partners that assist us with our marketing and communication, and service providers that help us to prevent and detect fraud. These service providers will have access to your information in order to provide their services to us.
As Directed By You and With Your Consent
We may share information with companies, organizations or individuals outside of Yourgi at your direction or when we have your consent to do so.
Legal Proceedings
We may share information with third party companies, organizations, governmental authorities, or individuals outside of Yourgi if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:
- Meet any applicable law, regulation, subpoena, legal process or governmental request;
- Enforce a contract, including but not limited to any applicable Terms of Service, including investigation of potential violations thereof;
- Detect, prevent, or otherwise address fraud, security or technical issues; or
- Protect against harm to the rights, property or safety of Yourgi, our users, customers or the public as required or permitted by law.
Sale or Merger
We may share information about you as part of a merger or acquisition. If Yourgi is involved in a merger, asset sale, financing, liquidation or bankruptcy, or acquisition of all or some portion of our business to another company, we may share your information with that company before and after the transaction closes. In such a case, unless permitted or otherwise directed by applicable law, your information would remain subject to the terms of the applicable privacy policy in effect at the time of such transfer.
Aggregate Information
We may de-identify or aggregate any information that we collect from or about you so that you are not identified as an individual, and use and disclose that information to third parties without restriction, including for commercial purposes. We may also provide aggregate usage information and data to third parties (or allow third parties to collect that information from you), who may use such information to understand how often and in what ways people use our Services. However, we never disclose aggregate usage or de-identified information to a third party (or allow a third party to collect such information) in a manner that would identify you as an individual person.
CHOICES ABOUT YOUR INFORMATION
We strive to provide you with choices with respect to your personal information. Also, remember, you can opt not to disclose certain information to us - but keep in mind some information may be needed to create a Yourgi account or to take advantage of some of the features of our Services.
Modification and Access to Your Information
If you have a Yourgi account, you can access and modify most of your account information directly in your Yourgi account. If you would like to modify or access additional information that is not available through your account, please contact us at legal@yourgipet.com]. We may ask you to verify your identify or provide additional information before we act on your request. We may reject or deny requests for certain reasons, such as when we believe a request is fraudulent, or when we are required to retain information for legal or record-keeping reasons.
Deleting Your Information or Your Yourgi Account
If you have a Yourgi account, you can delete your directly in your Yourgi account. You may also request deletion of your account by contacting us at legal@yourgipet.com. Please note that in some cases we may be prohibited from deleting certain information (we will let you know in those situations), and some information may remain in our records after your deletion of such information from your account. We may use any aggregated or de-identified data derived from or incorporating your information after you update or delete it, but not in a manner that would identify you personally.
Marketing
You may unsubscribe from our marketing communications at any time by following the “unsubscribe” link at the bottom of any such communication. Most promotional communications will also offer recipients choices about receiving additional messages.
INTERNATIONAL TRANSFER
We are based in the United States, and our Services are hosted there. If you are using our Services from another country, the laws governing our collection and use of information may be different from the laws of your country. If you decide to use our Services, or share your information with us, you are agreeing to be governed by the laws of the United States, and agree to the transfer of your information to the United States.
HOW LONG WE KEEP YOUR INFORMATION
Generally, we keep your information for as long as you tell us to, and otherwise as long as we need it to provide our Services, as permitted by law.
CHILDREN
Our Services are not directed at children under 18, and we do not knowingly collect information from children under 18. If you are under 18, please do not attempt to use our Services or send any information about yourself to us.
SECURITY OF YOUR INFORMATION
We use reasonable security measures, including measures designed to protect against unauthorized or unlawful processing and against accidental loss, destruction or damage to your information. We also take certain measures to enhance the security of our Services, however, since the Internet is not a 100% secure environment, we cannot guarantee, ensure, or warrant the security of any information you transmit to us. THIRD-PARTY WEBSITES AND SERVICES
Our Services may contain links to other websites and Services operated by third parties, and may include social media features such as X, Facebook, and Instagram buttons or links. These third-party websites and services may collect information about you if you click on a link or visit those websites or services, and the social media sites may automatically record information about your browsing behavior every time you visit a website that has a social media button. Your interactions with these features and third parties are governed by the privacy policy of the third party, not by this Policy.
CALIFORNIA RESIDENTS
California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of the Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
